After restricting eviction proceedings in Washington State for a total of 18 months due to the Coronavirus pandemic, Governor Jay Inslee will let the eviction moratorium expire on October 31, 2021.

In a press conference earlier this week, Inslee said "We have to have some end to the moratorium. You can't have an economy ultimately where just nobody pays rent." Based on data from Statista.com, the state's real GDP growth declined from an impressive 6.8% in 2018 compared to the previous year to -0.6% in 2020.

Many fear that the moratorium's expiration will lead to a large influx of new eviction cases and while many tenant advocates continue to urge Inslee to extend the moratorium, others see it as an opportunity to test key tenant protections for the first time since the pandemic started.

All evictions in the state of Washington, hence forth, must adhere to the guidelines mandated by the Eviction Resolution Pilot Program (ERPP). Before landlords can initiate eviction proceedings, they are now required to inform tenants, through written notice, existence of the ERP along with a 14-day termination notice for nonpayment, and to send copies of these notices to a local dispute resolution center.

Landlords are required to offer repayment plans for any unpaid rent accrued between March 1, 2020 and December 31, 2021 or up until the end of the declared public health emergency. Additionally, no late fees can be imposed during this time.

Seattle, Burien and Kenmore have their own eviction moratoriums.

Although the statewide moratorium is set to expire at the end of this month, local lawmakers in Seattle, Burien and Kenmore have elected to implement their own eviction moratoriums that will last until January 15, 2022.
